Filing a Complaint
In North Dakota, it is illegal to discriminate in employment, housing, public accommodations, government services and credit transactions on the following basis.
- Race
- Color
- Religion
- National Origin
- Sex
- Age (40 years of age or older)
- Disability
- Marital Status
- Status as a Recipient of Public Assistance
- Familial Status (having children under age 18, being pregnant, or being in the process of securing legal custody of a child under age 18) (housing only)
- Participation in lawful activity off the employer's premises outside of regular work hours that is not in direct conflict with the business-related interests of the employer (employment only)
In addition to the mentioned above, the Fargo Human Relations Commission tracks discrimination complaints related to Sexual Orientation and other basis even though they may not be covered under ND State Law. If you believe you have been discriminated against on the basis of any of the protected classes:
1. Keep accurate records to help justify your claim by tracking dates, incidents, witnesses and others that may have experienced similar problems;
2. Contact the Fargo Human Relations Commission; and/or
3. Contact the ND Department of Labor's Division of Human Rights; and/or
4. File a complaint by completing a Discrimination Incident Form (pdf).

The ND Department of Labor's Division of Human Rights
is responsible for enforcing the North Dakota Human Rights Act and the North Dakota Housing Discrimination Act. This responsibility includes investigating complaints alleging discriminatory practices, educating the public about human rights laws, and studying the nature and extent of discrimination in North Dakota. In-person complaints can be filed with the division in Fargo on the first Wednesday of each month from 1 to 5 p.m. at the Southeast Human Service Center, 2624 9th Ave. SW.
